This book contains the written and oral
presentations made during a Colloquium on provisional and conservatory
measures in international arbitration held at the ICC headquarters in
Paris, in November 1992. At this important meeting leading scholars
emphasized the need to differentiate the various provisional measures which
may be requested by the parties, according to the type of remedy sought and
the jurisdiction – state court or arbitral tribunal – to which and
application is made. The meeting also stressed the complementary role of
state courts and arbitral tribunals with regard to these measures.
